AIR MAX DISPUTE First email from Buyer:
Shoes arrived, but they are not what you described. These are called “Throwdown”. I bought when you said “AIR MAX”. These are not an air model of Nike shoes. I have meta-tarsalgia and require the air shoes.
Seller’s reply:
This exactly what the auction says and it is exactly what is on the box. “style: Throwdown Nubuck”

2nd email from Buyer:
I know what your listing said and I used that in my decision to bid. I suggest you agree to refund my purchase price plus shipping which is $27.00 plus an additional amount of $7.85 which was your Priority Mail shipping expense. This I will incur to ship it back to you. In the event you are unable to agree to this, I will ship the shoes to Ebay corporate headquarters in California with a copy of all our communications. I can’t use them and they can judge the merit of my position. TO THE SUCCESS OF YOUR ENDEAVORS
Seller’s second reply:
In the auction itself I said exactly what the shoe was. I do not know how that was misleading anyone. I have over 480 positive feedbacks and I try to resolve any and all probelms. When you list an item, as Ebay will tell you the more you put in the top part the more views you have. In the actual description I said they were “throwdowns”. As in many auctions I have people emailing me first if they have a question about the shoe BEFORE they bid, as a question I received today about a woman with prothstetics and wanted to know if the insoles were removable, which I try to answer all questions. It states in the specifics that they are basket ball shoes and the style which is Throwdown. How do you want to resolve this?
3rd email from Buyer:
You have made your decision and I will take my action of remedy.
SELLER’S LAST REPLY:
Due to the facts that:
!. You saw the picture of the item;
2. You read the description that said Nike Air Throwdown:
3. That it stated they were basketball shoes;
4. That it was listed that the shoes were nonreturnable unless the wrong shoes were sent (which the exact shoes were sent that was in the description and picture)
5. If you require orthopedic shoes then maybe you should look for that in the description of the shoes, since these did not say they orthopedic shoes, they said they were Throwdown Basketball shoes.
6. The only way I would refund your money if the shoes were not what was said in the auction, which they were.
I do not like the harassment that you are giving me and I too can forward this to safe harbor, since I have done nothing wrong because you can not see or read the description of an auction and if you had a problem then should have asked a question before you bid if these were orthopedic shoes, if that’s what you need.
